On Thursday, 28 January 2021 in Sarajevo, the AIRE Centre and the Constitutional Court of Bosnia and Herzegovina presented their new guide on the right to a trial within reasonable time. This guide resulted from discussions made during the Third Annual Judicial Forum for Bosnia and Herzegovina, held in November 2019, where it was agreed that national courts were obliged to apply the standards set by the European Court of Human Rights and the Constitutional Court of Bosnia and Herzegovina in relation to the length of court proceedings. It was stressed that every case had to be assessed in its particular circumstances and that specific attention had to be paid to the following factors: time; complexity; the conduct of the parties, courts and public authorities; as well as the significance of the matter to the parties in the proceedings. This Guide is intended to benefit judges, lawyers, prosecutors, ombudsman, academic researchers and journalists by providing an explanation of European standards and then an overview of the domestic situation in BiH.
The Guide is available in official languages of Bosnia and Herzegovina and may be accessed here.
