This publication offers information on positive legislation and Montenegrin case law, in the context of all aspects of Article 5 of the European Convention. With the aim of improving the application of the standards, the key principles of the right to liberty and security are explained, and an overview of significant decisions of the European Court made in relation to the countries of the Western Balkans is presented.
